7. NO LIABILITY / HOLD HARMLESS (STRONG CLAUSE)
The Client expressly agrees that:
POSITION Consultants, its owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to:
• Use of coaching or consulting services
• Reliance on advice, tools, or materials
• Business, financial, or personal decisions
• Loss of revenue, profits, opportunities, or relationships
• Organizational performance or outcomes
• Emotional, psychological, or professional impact
The Client agrees to indemnify, defend, and hold harmless POSITION Consultants from any and all claims, liabilities, losses, damages, costs, or expenses (including attorney fees) arising from:
• The Client’s use or misuse of services
• Actions taken based on coaching or consulting
• Breach of this agreement
• Third-party claims related to Client conduct
POSITION Consultants makes no warranties or guarantees regarding results, performance improvements, or outcomes.
8. Payment & Refunds
Unless otherwise stated in a written agreement:
• Payments are due as invoiced
• Deposits are non-refundable
• Services rendered are not eligible for refund
• Cancellations may be subject to fees
9. Limitation of Liability
To the fullest extent permitted by law:
Any liability of POSITION Consultants is limited to the amount paid by the Client for the specific service giving rise to the claim.
10. Third-Party Links
